Sometimes you may be necessary to return a product you have purchased from a Chevpac Machinery, to assist you, we have set out below the Returns Policy that you should read and understand.

Our Returns Policy includes the rights you have under the Consumer Guarantee’s act and other relevant laws. Your Rights under the Consumer Guarantees Act 1993 – Our goods come with guarantees that cannot be excluded under the New Zealand Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

1. You shall inspect the Goods on delivery and shall within seven (7) days of delivery (time being of the essence) notify Chevpac Machinery of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote.

2. You shall also afford Chevpac Machinery the opportunity to inspect the Goods within a reasonable time following delivery if you believe the Goods are defective in any way.

3. If you shall fail to comply with these provisions the Goods shall be presumed to be free from any defect or damage. For defective Goods, which Chevpac Machinery has agreed in writing that you are entitled to reject, Chevpac Machinery’s liability is limited to either (at the Chevpac Machinery’s discretion) replacing the Goods or repairing the Goods except where you have acquired Goods as a consumer within the meaning of the Fair Trading Acts of New Zealand and is therefore also entitled to, at the consumer’s discretion either a refund of the purchase price of the Goods, or repair of the Goods, or replacement of the Goods.

Returns will only be accepted provided that:

(a) You have complied with the provisions outlined above.

(b) Where the Goods are unable to be repaired, the Goods are returned at your cost within thirty (30) days of the delivery date, and

(c) Chevpac Machinery will not be liable for Goods which have not been stored or used in a proper manner.

(d) The Goods are returned in the condition in which they were delivered and with all packaging material, brochures and instruction material in as new condition as is reasonably possible in the circumstances.

4. Chevpac Machinery may (at their sole discretion) accept the return of Goods for credit but this may incur a handling fee of up to fifteen percent (20%) of the value of the returned Goods plus any freight costs.

5. Where a failure does not amount to a major failure, Chevpac Machinery is entitled to choose between providing you with a repair, replacement or other suitable remedy.

6. Your rights under the Consumer Guarantee’s Act are not limited by a defined time.

Goods may be returned to Chevpac Machinery provided that: (i). You (the purchaser refund, this will be determined upon the receipt of your goods to the designated Chevpac Machinery Warehouse

Return of goods (other than in situations where the Seller is required to accept a return of goods under the Consumer Law) must be approved by the Seller named in the relevant Sales Invoice or Instrument of Agreement. These authorized returns must be freight prepaid and will only be accepted if (unless otherwise agreed with the Seller) they are:

(a) In a saleable condition in their original packaging;

(b) Accompanied by documentation evidencing:

• I. The Buyer’s name, address and account number,
• II. A return authorisation number and the relevant Sales Invoice number or Instrument of Agreement number under which the goods were originally supplied
• III. Reasonable detail regarding the reason for the return of the goods; and

(c) Returned within 7 days of supply.

(d) If all the above conditions are not met, Chevpac Machinery reserves the right, at its own discretion to cancel and dishonour a return authorisation request.
